TERMS AND CONDITIONS
BOOKINGS/ CANCELLATION/ ALTERATIONS
Booking is confirmed once the owners (Mary Gray Narrowboat holidays) have
received a signed booking form with a deposit of 20% of the total hire fee. The
customer will recieve a Confirmation of Booking with an invoice within 7 working
days.
If the customer has to cancel the booking, it must be done in writing.
The deposit will be returned less 15% up until four weeks before the date of
hire was due to commence; a cancellation within four weeks of the due hire date
would result in a loss of the deposit. Any alterations to the booking must be
done in writing. Non payment of the
balance 4 weeks prior to the confirmed hire period will constitute a
cancellation by the hirer and the deposit shall be retained.
PRICE AND PAYMENT
A deposit equal to 20% of the total price is required with the completed
booking form, and is payable by cheque.
The balance of the total price will be due 4 weeks prior to the confirmed
hire period. If the balance has not
been received by this due date, the owners shall contact the hirer by telephone.
If the balance is still not received, the owners will send the hirer a letter
requesting payment. If the balance is
not received within 3 working days the
booking will be deemed as cancelled by the hirer (see bookings/
cancellations/ alterations.).
For bookings made within 4 weeks of the confirmed hire period, the full
price would be payable.
HIRE PERIOD
Every endeavour shall be made
to ensure that the boat is available and ready for hire at the location, time
and date confirmed at time of booking.
The customer shall be responsible for checking the condition of the boat
and the inventory immediately after
taking possession of it, and shall sign a Boat Acceptance and Inventory Form
prior to departure
The customer shall take all reasonable care of the boat and shall return
it, together with its equipment and contents, in a clean and tidy condition, no
later than the time agreed and confirmed.
A fee may be charged if the boat is not in accordance with this. Any
breakages or damage should be reported and may be charged for.
INSURANCE
The boat is insured for fixtures, fittings and equipment against loss or
damage accepting that the first £70 of each claim is the responsibility of the
hirer. The price the customer pays
includes the cost of insurance for third party liability and damage cover
representing the excess payable under the boat insurance. It does not include
personal insurance.
The following are also not covered by the boat insurance:-
Damage to the boat arising directly or indirectly from - rudder and
tiller damage; roof equipment; malicious or deliberate
damage by the customer ,
members of customer’s party or any guests of customer; speeding; return of the
boat in a dirty
condition;
CUSTOMER’S OBLIGATIONS
The customer must be a minimum of eighteen years of age and must agree
not to permit any person under the age of eighteen years to drive the boat
unless closely supervised by a
competent person over the age of eighteen.
The customer must not:-
tow another boat or allow the boat
to be towed, unless in an emergency
Travel during the hours of darkness, thick fog, on tidal waters or on the
Break any speed limits, or travel at speed which creates a breaking wash
or inconveniences other waterway users.
Take any inflammable liquids, barbeques, bicycles, dinghies, canoes,
electrical equipment without prior consent
Use the boat for business purposes or
permit any persons other than those named on the booking form to occupy
or
travel on the boat.
The customer agrees to:-
Comply with rules, regulations and legislation relating to the use of
waterways
Comply with boat operating procedures
ACCIDENTS/REPAIRS/BREAKDOWN
In the event of an accident, damage to boat, breakdown or mechanical
problem, the customer must inform the owner immediately
And also:-
obtain and record names addresses and registration numbers of other
persons/boats involved in an accident
Must not take responsibility for the accident or admit liability
Provide full details of any breakdown or mechanical failure, but must not
endeavour to to undertake any repairs
unless requested to do so.
Every effort will be made to rectify any breakdown/ mechanical failure as
soon as is practicably possible following notification
If it is not possible to repair the problem due to breakdown, mechanical
failure or accident, the customer will be either re-imbursed or offered
an alternative boat,
providing that the customer has not breached any of the conditions.
PERSONAL EFFECTS
The owners do not accept any responsibility for any loss or damage to
hirer’s property. Hirers are responsible for any charges made against them by
canal or other water authorities for damage or wastage of water due to hirers
failing to close lock gates or paddles.
DELAYS
The owners cannot accept responsibility for delays due
to stoppages, drought, flood, strikes, fuel shortage or other circumstances
beyond their control. Delays can happen at locks at busy times or if lock gates
are obstructed and hirers should allow for this in their plans.
CONFIRMATION OF ABILITY
Prior to the boat being handed over to the hirer, the
hirer shall sign a ‘confirmation of ability’. Thereafter the hirer is completely
responsible for the boat, its equipment, its passengers, and its operation,
until it is handed back to the owners at the end of the hire period.
The owners reserve the right not to hand over the boat
to any hirer whom they do not consider to be a fit person to take charge.
Should the owners, due to circumstances beyond their
control, be unable to supply the craft on the date booked, and should it not be
possible for the owners and hirers to agree on a suitable alternative, the
owners shall refund in full all money paid by the hirer. The hirer will then
have no further claim against the owners.
